3. General information about data processing

We only collect and process our website users’ personal data to the extent required to ensure the provision of a functioning website and presentation of our content and services.

Personal data is information which can be attributed to you personally, such as your name, e-mail address, place of residence, gender, date of birth, telephone number or age. Information such as the number of users that visit a website is not personal data.

3.2.1. Contact

If you wish to contact us, you can send an e-mail to info@gutmann.de or a specific contact at any time. We guarantee that we will only use your e-mail address in order to reply to your request. The legal basis for the processing of your data in this context is Art. 6 Para 1 lit. b, Art. 6 Para 1 lit. f GDPR. As soon as your request has been completed and the corresponding issue definitively resolved, the personal data that you entered on the contact form will be deleted. In individual cases, the data may continue to be stored if this is required by law.

3.2.2. Applicant management

If you are interested in one of the vacancies advertised on our website, you can send an e-mail to personal@gutmann.de at any time. We guarantee that we will only use the personal data you have submitted in order to process your application. Your data will be stored for 6 months after completion of the application process (acceptance or rejection). The legal basis for the processing of the personal data from your application documents is Art. 6 Para 1 lit. b GDPR.

3.3. Legal basis for processing personal data

As a rule, a user’s personal data is only collected and processed with his or her prior consent. In so far as we obtain a user’s consent to use and process his or her personal data, Art. 6 Para. 1 lit. a GDPR is the legal basis for the processing of personal data.

Cases in which there are substantial reasons why it is not possible to obtain consent in advance, and the processing of data is explicitly permitted by law, are an exception. When it is necessary to process personal data for the purpose of fulfilling a contract to which the data subject is a party, the legal basis is Art. 6 Para. 1 lit. b GDPR. This also applies to any processing required for the performance of pre-contractual measures.

If it is necessary to process personal data in order to fulfil a legal obligation to which we are subject, the legal basis is Art. 6 Para. 1 lit. c GDPR.

If personal data must be processed to protect the legitimate interests of our company or a third party, and if the interests of the individual data subject are subordinate to the interests, fundamental rights and fundamental freedoms of us or the third party, the legal basis for processing the data is Art. 6 Para. 1 lit. f GDPR.

The transfer of personal data between your computer or mobile device and our server is always encrypted (SSL method, Secure Socket Layer).

4. CONSENT USING COMPLIANZ

To obtain your consent to store certain cookies on your computer or mobile device, or to use certain technologies, and to document such storage or use in accordance with data protection law, our website uses Complianz consent technology. This technology is provided by Complianz B.V., Kalmarweg 14-5, 9723 JG Groningen, The Netherlands (hereinafter: “Complianz”).

Complianz is installed locally on our servers, so there is no connection to the servers of the Complianz provider. Complianz stores a cookie on your browser which enables the granting or withdrawal of consent to be attributed to you. The data stored in this way remain on file until you request their deletion, delete the Complianz cookie yourself, or until the reason for storing the data no longer applies. Any mandatory legal requirements for data storage remain in force.

We use Complianz to obtain consent for the use of cookies, as required by law. The legal basis is Art. 6 Para. 1 lit. c GDPR.

5. Matomo (formerly Piwik)

This website uses the open-source web analysis service Matomo. The technology used by Matomo enables cross-site recognition of the user for the purpose of user behaviour analysis (e.g., cookies or device fingerprinting). The information about use of this website that Matomo collects is stored on our server. The IP address is anonymised before storage.

Matomo enables us to collect and analyse information about how visitors use our website. Among other things, this allows us to determine when which pages were accessed, and from which region. We also register various log files (such as IP address, referrer, browser used and operating systems) and can measure whether our website users carry out certain activities (e.g., clicks, purchases etc.).

The legal basis for the use of this analysis tool is Art. 6 Para. 1 lit. f GDPR. The  website operator has a legitimate interest in an anonymised analysis of user behaviour, which allows him to optimise the content of both the website and his advertising. Once corresponding consent has been obtained (e.g., consent to the storage of cookies), processing takes place exclusively on the legal basis of Art. 6 Para. 1 lit. a GDPR; the user may withdraw his consent at any time.

5.1. Hosting Matomo (formerly Piwik)

We host Matomo exclusively on our own servers, so we retain all analysis data and do not communicate them to third parties.

You have the option to prevent the analysis and linking of your activities on this website. Although this will protect your privacy, it will also prevent the website operator from learning from your activity, and thereby from improving the user experience for you and other users.

You may choose to prevent this website from aggregating and analyzing the actions you take here. Doing so will protect your privacy, but will also prevent the owner from learning from your actions and creating a better experience for you and other users.

6. Security measures to protect the data stored by us, SSL technology

We have implemented organisational and technical security measures to protect your data, in particular against loss, manipulation or unauthorised access. We update our security measures regularly in line with continuous technical development. We provide our employees with in-depth information and training, and they are contractually obliged to maintain data confidentiality, so you can be sure that your data is treated confidentially. As a rule, the transmission of personal data between your computer or mobile device and our server is encrypted (SSL procedure, Secure Socket Layer).

7. Use of service providers for processing personal data / Processing data in countries outside the European Economic Area

We use service providers to provide services and process your data relating to our services and products. These service providers process the data exclusively in accordance with our instructions and are obliged to comply with the applicable data protection regulations. All contractors have been carefully selected and will only have access to your data to the extent and for the time required to provide the services or to the extent to which you have consented to the processing and use of your data.

Service providers in countries such as the USA or in countries outside the European Economic Area are subject to data protection laws that do not generally protect personal data to the same extent as is the case in the Member States of the European Union. If your data are processed in a country that does not have such a recognised high level of data protection as the European Union, we use contractual agreements or other recognised instruments to ensure that your personal data are adequately protected.

8. Storage period

We only store your personal data as long as permitted by applicable law. Stored personal data will be deleted if the user withdraws his or her consent to its storage or if the data are no longer required to fulfil the purpose for which they were stored, in particular if the user account is deleted or if their storage is unlawful for other legal reasons. This does not affect any other applicable legal retention periods from the German Commercial Code or the Fiscal Code. During legal retention periods, your personal data will be blocked and not used for any other data processing.

9. Rights of data subjects

9.1. Right to information

You have the right to request information from us at any time about the data stored by us, as well as its origin, recipients or categories of recipients with whom this data is shared and the purpose of storage (Art. 15 GDPR).

9.2. Right to withdraw consent

If you have consented to our use of your data, you may withdraw this consent at any time with effect for the future and without giving any reasons. An e-mail to: info@gutmann.de or a written withdrawal sent by post to: GUTMANN AG, Nürnberger Str. 57, 91781 Weissenburg / Bay. is sufficient.

9.3. Right to rectification

If your data stored by us is incorrect, you can ask us to rectify them at any time (Art. 16 GDPR).

9.4. Right to erasure and restriction of processing

You have the right to restrict processing of your personal data and the right to erasure of your personal data stored by us (Art. 17 GDPR). As a rule, your personal data will be erased within 2 working days after you have exercised this right. Should erasure conflict with legal, contractual or fiscal or commercial law retention obligations, or other legally mandated grounds, your data will be restricted from further processing but will not be erased. Once your data have been erased, it will no longer be possible to disclose information.

9.5. Right to data portability

Should you request the return of your personal data provided to us, we will release or transmit the data to you or another controller, if you so desire, in a structured, commonly used and machine-readable format. However, the latter is only possible if technically feasible (Art. 20 GDPR).

9.6. Right to withdraw consent

You have the right to withdraw your consent to data processing at any time and without giving reasons (Art. 7 Para 3 GDPR). However, once you have exercised your right to withdraw consent, it is possible that we may no longer be able to offer our services in full, as certain services require the processing of certain personal data.

9.7. Contacting us to exercise your rights as a data subject

If you contact us by e-mail at info@gutmann.de or by post at Gutmann AG, Nürnberger Str. 57, 91781 Weissenburg, we will store the data you provide (your e-mail address, your name and your telephone number if applicable) in order to answer your questions or comply with your request. The data provided in this context will be deleted when their storage is no longer necessary, or their processing restricted if their continued retention is required by law.
